Terms and conditions

1. OVERVIEW

The following Terms and Conditions are set out for purchases on the website www.chantellebell.com‎. Please note that this translation of the Terms and Conditions is general and informative and provided for convenience only. The German language version is intended to be legally binding. You can find the German version here.

2. Contracting partner, contract conclusion

Purchases are made with Chantelle Bell Illustration, Treskowallee 20, 10318 Berlin, Deutschland.

In the online shop we offer the product until the moment of purchase. You can place your article in the shopping cart and edit your details at any time before payment. The agreement of purchase comes into effect when you click on the order button in the shopping cart. Immediately after purchase you will receive a confirmation email.

3. Contract language, saving the contract

‎The service of ordering from our shop is offered in English and German.We will save the contract text and send you the order details via email. For security reasons the contact text will no longer be available online.

4. YOUR PERSONAL DATA

We will process the necessary customer data relevant for business transactions with due consideration of the data protection regulations. We will use and save the personal data (as for example name, address, payment data)  from your order exclusively for the fulfillment and completion of your Order. Your personal data will exclusively be used to handle your request and will not be passed on to third parties. The transaction is completed with the service provider Squarespace (Squarespace, Inc., 8 Clarkson St, New York, NY 10014, USA). During an order your data will be transferred to the USA and saved there. The company is committed to adhering to the European data protections law (europäisches Datenschutzrecht).

You have the right to receive information free of charge on your personal data stored. You are also entitled to have your data corrected, blocked or deleted.

You agree to provide current, complete and accurate purchase and account information for all purchases made in our shop.

5. delivery conditions

Additional to the product prices there can be a shipping cost. The individual shipping cost varies for each product and can be found on each individual listing. Picking the product up from the production location is not possible

6. payment

Payment is 100% secure and through a service called Stripe. You can read about Stripe's security here. In our shop we offer the following payment methods:

CARD

We accept Visa, Mastercard and American Express payments from customers. At the end of the ordering process you can type in your card details. After the credit card network clears the payment, authorisation is requested from the issuing bank. The payment transaction is then processed and the funds will be transferred from your account.

paypal

We accept payment via PayPal. In order to use this method of payment, you must have an account with PayPal which uses your email address to process the transaction. The payment transaction retrieves the correct amount from your bank account and there is immediate confirmation about the success or failure of a payment.

SOFORT Überweisung

Customers in Austria, Belgium, Germany, Italy, Netherlands and Spain can use this method of payment. During the payment process you will be redirected to SOFORT Überweisung’s website to authorise the payment. In order to use this method of payment, you must have an activated online bank account with the PIN/TAN process to authorize and confirm payment. You will be notified further during the process. The payment transaction retrieves the correct amount from your bank account and there is immediate confirmation about the success or failure of a payment.

Giropay

Customers in Germany can use this method. During the payment process you will be redirected to your bank’s website or mobile application to authorise the payment. In order to use this method of payment, you must have an activated online bank account with the PIN/TAN process to authorize and confirm payment. You will be notified further during the process. The payment transaction retrieves the correct amount from your bank account and there is immediate confirmation about the success or failure of a payment.

7. ownership

The products remain in our possession until the payment process has been completed.

8. shipping damage

If products are delivered visibly damaged, you should make a claim as soon as possible with the delivery company (within 5 working days) and contact us immediately. If you do not inform us within 2 working days we will not be able to guarantee a partial refund. Submitting a complaint does not affect your lawful and warranty rights. This however helps us to claim against the transport carrier by informing them of the damages.

9. warranty and guarantee

Unless anything else is agreed upon, the warranty rights are set in place. The limitation period for warranty rights is in effect for one year on delivery of the product. This limitation does not apply to any indirect damage claims from ourselves, our legal representatives or vicarious agents.

·         in the case of harm to life, limb or health (personal injury),

·         in the case of intentional or grossly negligent breach of obligation or fraudulent intent,

·         in the case of negligence of provisions of the contract, which have a particular importance for achieving the purpose of the contract (cardinal duties)

·         in the case of an independent guarantee, unless no other agreements have explicitly been made

·         in the case that the product malfunctions according to the Produkthaftungsgesetz (German Product Liability Act)

Information regarding additional guarantees will be stated under the relating products in the online shop.

10. liability

The limitation of our liability to the damages which are typical for the contract and which are foreseeable also applies in the event of a damage caused by gross negligence by ourselves, our legal representatives or vicarious agents.

·         in the case of harm to life, limb or health (personal injury),

·         in the case of intentional or grossly negligent breach of obligation or fraudulent intent,

·         in the case of guarantee agreements, unless no other agreements have explicitly been made

·         in the case that the product malfunctions according to the Produkthaftungsgesetz (German Product Liability Act)

in the case of negligence of provisions of the contract, which have a particular importance for achieving the purpose of the contract (cardinal duties), the loss or damage caused by breach of fundamental contractual obligations due to ordinary negligence by us, our legal representatives or vicarious agents, the liability shall be limited to the loss or damage that is foreseeable and typical for the type of contract. All further claims by the user for damages are excluded.

11. dispute resolution

For extrajudicial settlements of consumer disputes, the European Union has launched an online platform ("ODR platform"): https://ec.europa.eu/consumers/odr. We are not required or prepared to attend an Independent Consumer Arbitration Service.

12. other

We do our best to represent the true colours of our products in the listing photos. However, we cannot guarantee that your screen settings display this correctly.

 

RETURN POLICY

It is your obligation to return the goods without delay and in any case within fourteen days from the day on which you inform us of your rescission of the contract, either by shipping them or delivering them personally. To comply with the time limit, it is sufficient to have mailed the goods within fourteen days. You are responsible for the immediate shipping costs when you return the goods. You are only responsible for any loss of value of the goods if this loss of value is due to your handling the goods in a manner which is not necessary to ascertain the state, characteristics and function of the goods.

We don't accept exchanges or cancellations. Because of the nature of these items they can't be returned or exchanged: custom or personalised orders, and items on sale or discounted. Conditions of return: Buyers are responsible for return shipping costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.
